iHEALTHSPOT PRIVACY POLICY

Michigan Medical Advantage, Inc. doing business as iHealthSpot (“iHealthSpot”), recognizes the privacy needs of its Clients. Protecting personal information is vitally important and we maintain this Privacy Policy in order to explain our information practices and to demonstrate our commitment to the privacy and protection of Client information. iHealthSpot and its contractors are obligated to respect the confidentiality of personal data. iHealthSpot reserves the right to make changes to this Privacy Policy at any time.
Collected Information
When you order web design, hosting or other services from us, we require certain personal information to allow us to process your order, start providing you with the services you order from us, and to administer and service your account and provide ongoing technical support. The information you provide to us and that we maintain in our Client account records ranges from basic contact information, to payment information, to technical information about your web site.
We collect Client credit card information. We use CyberSource to handle this form of payment processing. We do not control how CyberSource will use Client's information.
iHealthSpot is licensor of certain third party service provider software. We are not responsible for the privacy practices of these companies. However, in order to maximize protection of your information, we endeavor to only partner with those providers who demonstrate commitment to privacy and protection of Client information.
In some cases we may ask for additional information in order to provide technical support. Any such additional information would be of a technical nature. iHealthSpot may access Client Data and other information for technical processing purposes including: (a) the functionality of the Service; (b) the technical requirements of iHealthSpot’s network; (c) the technical requirements of the Services; or (d) to conform to other, similar technical requirements. iHealthSpot. may access Client's account and its data as necessary to identify or resolve technical problems or respond to complaints about the Services.
iHealthSpot may also collect certain information from visitors to its Websites, such as Internet addresses. This information is logged to help diagnose technical problems, and to administer our Website and Services in order to constantly improve the quality of the Service.
Disclosure of Information
iHealthSpot maintains information about Client, including without limitation Client's account registration information, user account information, billing information, services and support information, and frequency and use of Services. iHealthSpot may use this data for internal business purposes, or disclose data in aggregate form (i.e., not individually attributable to Client) for marketing or other promotional purposes. iHealthSpot will not sell, rent, trade or otherwise disclose any personally identifiable information to any third parties or outside companies for any reason without first receiving permission from the Client.
We cannot ensure that all personally identifiable information will never be disclosed in ways not described in this Privacy Policy. For example, iHealthSpot may disclose Client Data if iHealthSpot believes that such action is reasonably necessary: (a) to comply with the law; (b) to comply with legal process; (c) to enforce our Service Agreement; (d) to respond to claims that the Client uses the Services to support activities that violate the law or the rights of third parties; or (e) to exculpate iHealthSpot from charges of wrongdoing. However, iHealthSpot does not have a duty to make any such disclosures.
If iHealthSpot is purchased or merges with another company, or if iHealthSpot becomes insolvent or files for bankruptcy, Client agrees that all information and data may be transferred to a purchasing party, subject to the provisions of any written agreement that may exist between iHealthSpot or its affiliates and Client. "Client Data" means that information and data stored by Client with iHealthSpot through use of the Services.
Data collected using our forms service travels over a secure line (SSL) with emails encrypted. However, no data transmission over the Internet can be guaranteed to be 100% secure, and we do not warrant that your information will be absolutely secure. Any transmission of data on or through the use of our Services is at Client’s own risk.
Use of Information
The use of an individual's e-mail address is necessary to keep our Clients well informed of maintenance issues, escalated critical issues and problem resolutions that may arise with your iHealthSpot.
Cookies
When you interact with an iHealthSpot’s Website we strive to make that experience easy and meaningful. When you come to our Website, our Web server sends a cookie to your computer. Cookies are files that Web browsers place on a computer's hard drive and are used to tell us whether Clients and visitors have visited the Site previously.
Standing alone, cookies do not identify you personally. They merely recognize your browser. Unless you choose to identify yourself to iHealthSpot, either by responding to a promotional offer, opening an account, or signing up for our Services, you remain anonymous to iHealthSpot Cookies come in two flavors: session and persistent-based. Session cookies exist only during an online session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you've closed your browser or turned off your computer. They include such information as a unique identifier for your browser.
iHealthSpot uses session cookies containing encrypted or encoded information including your username and session ID. This information allows iHealthSpot to process your online transactions and requests. Session cookies help us make sure you are who you say you are after you've logged in and are required in order to use the iHealthSpot services. iHealthSpot uses persistent cookies that only iHealthSpot can read and use, to identify the fact that you are an iHealthSpot Client or prior iHealthSpot Website visitor (whatever the case may be). We are especially careful about the security and confidentiality of the information stored in persistent cookies. For example, we do not store account numbers or passwords in persistent cookies. Users who disable their Web browsers' ability to accept cookies will be able to browse our Website but will not be able to successfully use our service.

iHEALTHSPOT ACCEPTABLE USE POLICY

This Acceptable Use Policy ("Policy") governs the usage of products and services, (“Services”), provided by Michigan Medical Advantage, Inc. doing business as iHealthSpot, (hereinafter referred to as “Company”). This Policy is incorporated by reference into each contract Company enters into with a client (each, a "Client") for the use of such Services. Company may modify this Policy at any time without notice.
The purpose of this Policy is to enhance and maintain the quality of the Services and to protect Company’s Clients, and the Internet community as a whole, from illegal or disruptive Internet activities, (“Prohibited Uses”), as further described below. This Policy applies to each Client and its employees, agents, contractors or other users of such Client who obtain Services from Company (each such person being a "User").
Use of the Services in connection with a Prohibited Use shall be considered a violation of this policy. If Company learns of a violation of this Policy, Company will respond to the applicable Client and in Company’s sole discretion, may (i) warn the Client; (ii) suspend Services; (iii) terminate the Services; (iv) remove the offending content; or (v) take any other appropriate action to remedy the violation.
Company expressly disclaims any obligation to monitor its Clients and other Users with respect to violations of this Policy. Company has no liability or responsibility for the actions of any of its Clients or other Users or any content any User may post on any Web site.
Company encourages Users to report violations of this policy by e-mail to: info@ihealthspot.com, including in any such report the name of the offending domain (for example, xyz.com) and the type of abuse (for example, spam, illegal acts, harassment, etc.) in the "subject" field of the e-mail.
Company reserves the right to cooperate with appropriate legal authorities in investigations of claims of illegal activity involving Company’s Services, Clients and other Users. Company reserves all other rights to respond to violations of this Policy to the extent of applicable law and in accordance with any applicable contractual obligations. Company may utilize technical means to monitor communications into, and out of, its network facilities to prevent the introduction of viruses or other hostile code, to prevent intrusions and otherwise to enforce this Policy and each Client agrees that Company is authorized to monitor its communications through its network for such purposes.
Assignment. Neither Client nor Company may assign any Agreement to any third party except upon the other party’s prior written consent, which consent shall not be unreasonably withheld or delayed; provided, that no such consent shall be required in the event of an assignment to an affiliate or to a successor-in-interest to the business of the assigning party resulting from a merger, reorganization, or sale of all or substantially all such party’s assets.
Assignment of Agreement by iHealthSpot, Inc. to Michigan Medical Advantage, Inc. d.b.a. iHealthSpot Any Agreement between Client and iHealthSpot, Inc. shall, as of December 20, 2022, be assigned to its parent company Michigan Medical Advantage, Inc. due to the merger of iHealthSpot, Inc. with and into Michigan Medical Advantage, Inc. All references in any Agreement to iHealthSpot, Inc. shall, as of December 20, 2022 be referenced as Michigan Medical Advantage, Inc. Any references to iHealthSpot shall remain as iHealthSpot due to the fact that Michigan Medical Advantage, Inc. is doing business as iHealthSpot under the terms of any Agreement.
Prohibited Uses
Without limiting the general application of the following rules, Users may not:
- Utilize the Services to send mass unsolicited e-mail to third parties.
- Utilize the Services in connection with any illegal activity. Users may not utilize the Services in any manner that violates applicable law or utilize the Services to:
- Copy material from third parties (including text, graphics, music, videos or other copyrightable material) without proper authorization;
- Misappropriate or infringe the patents, copyrights, trademarks or other intellectual property rights of any third party;
- Traffic in illegal drugs, illegal gambling, obscene materials or other any products or services that are prohibited under applicable law;
- Export encryption software to points outside the United States in violation of applicable export control laws; or
- Utilize the Services in connection with any tortuous or actionable activity. Users may not utilize the Services to:
- Publish or disseminate information that constitutes slander, libel or defamation; publicizes the personal information or likeness of a person without that person’s consent; or otherwise violates the privacy rights of any person.
- Threaten persons with bodily harm, to make harassing or abusive statements or messages, or to solicit the performance of acts or services that are illegal under applicable law.
- Utilize the Services in connection with any other disruptive or abusive activity. Users may not utilize the Services to:
- Cause denial of service attacks against Company or other network hosts or Internet users or to otherwise degrade or impair the operation of Company’s servers and facilities or the servers and facilities of other network hosts or Internet users;
- Post messages or software programs that consume excessive CPU time or storage space;
- Offer mail services, mail forwarding capabilities, POP accounts or autoresponders other than for the User’s own account;
- Resell access to scripts installed on Company’s servers;
- Subvert, or assist others in subverting, the security or integrity of any Company systems, facilities or equipment;
- Gain unauthorized access to the computer networks of Company or any other person;
- Provide passwords or access codes to persons not authorized to receive such materials by the operator of the system requiring the password or access code;
- Forge the signature or other identifying mark or code of any other person; impersonate or assume the identity or any other person; or engage in any other activity (including "spoofing") to attempt to deceive or mislead other persons regarding the true identity of the User (excluding the use of anonymous remailers or Internet nicknames);
- Distribute or post any virus, worm, Trojan horse, or computer code intended to disrupt services, destroy data, destroy or damage equipment, or disrupt the operation of the Services;
- Conduct port scans or other invasive procedures against any server (except any server for which the User is an authorized system administrator);
- Distribute, advertise or promote software or services that have the primary purpose of encouraging or facilitating unsolicited commercial e-mail or spam;
- Solicit or collect, or distribute, advertise or promote, e-mail address lists for the purpose of encouraging or facilitating unsolicited commercial e-mail or spam;
- Interrupt or interfere with the Internet usage of other persons.
- Utilize the Services in a manner which subject Company or its software providers to unfavorable action. Users may not utilize the Services to subject Company to any liability for any reason, or adversely affect Company’s public image, reputation or goodwill, including, without limitation, sending or distributing sexually explicit, hateful, vulgar, racially, ethnically or otherwise objectionable materials as determined by Company in its sole discretion.
iHEALTHSPOT ADVERTISING POLICY
